In Massachusetts, there are specific laws and regulations governing home improvement contractors. This is why Massachusetts enacted the Home Improvement Contractor Act (“HICA”) establishing regulations to govern the conduct of home improvement contractors doing business in Massachusetts, requiring home improvement contractors to register and providing remedies for aggrieved consumers. The HICA requires specific provisions to be included for all projects costing more than $1,000. In addition, the HICA prohibits contractors from abandoning any project, deviating from plans without the owner’s consent, requiring excessive deposits, or failing to properly credit payments. Violations of the Home Improvement Contractor Act are per se violations of the Massachusetts Consumer Protection Act (M.G.L. c. 93A.) which prohibits unfair and deceptive conduct in the course of business. As a result, violations of the HICA can result in a judgment against a home improvement contractor for up to triple damages, costs, and attorneys fees.
